Terms of Use

1. General

Helvetia Swiss Life Insurance Company Ltd, St. Alban-Anlage 26, CH-4052 Basel and Helvetia Swiss Insurance Company Ltd, Dufourstrasse 40, CH-9001 St. Gallen ("Helvetia") provide interested users with an online platform (at the following URL: www.helvetia.ch/en/real-estate) with functions for property owners and prospective purchasers ("real estate platform ").

By registering for the MoneyPark Cockpit, users declare their agreement with these Terms of Use in the respective current version published on the website at www.helvetia.com/ch/web/en/about-us/services/contact/legal-info.html. Information on data processing by real estate platform can be found at www.helvetia.ch/privacy.

2. Range of services

In connection with the MoneyPark Cockpit, Helvetia offers services for the use of the web application as well as the exchange of information between the user, Helvetia and its partners or its administration and partner systems("range of services"). The use of the MoneyPark Cockpit is free of charge.

As a user you receive the following personalized messages:

  • General product and service information
  • Announcement of new functions
  • Information on the property value
  • Number of prospective buyers
  • Property search subscription

Helvetia may expand, restrict, extend, discontinue or change the range of services at any time, even if this means that the user no longer has access to real estate platform (and certain of its data items).

3. Registration and access data

In order to use the MoneyPark Cockpit the user must register in accordance with the instructions of real estate platform. Helvetia may conduct an identity check and may also involve third parties (e.g. identity providers) for this purpose, namely to validate a user's mobile phone number or e-mail address. Registration is open to all persons.

After successful registration, users receive their MoneyPark Cockpit access data ("Access Data").

4. Usage rights and duties of care

a. Users

Users must keep their access data secret. They are responsible for any use, including misuse, of their access data in connection with real estate platform services.

Users undertake to use the MoneyPark Cockpit in compliance with the rights of third parties (e.g. copyright and trademark rights), not to violate legal regulations and not to transmit or refer to any illegal or immoral content.

Users may request that their access to the MoneyPark Cockpit be blocked, temporarily or permanently.

Users are entitled to stop using the MoneyPark Cockpit at any time. Users deleting their MoneyPark Cockpit access data deactivate their accounts.Access deletion results only in the termination of the contractual relationship regarding the MoneyPark Cockpit, not the termination of any other contractual relationships with Helvetia. The termination of other contractual relationships with Helvetia does not lead to the termination of the contractual relationship regarding the MoneyPark Cockpit, which users can continue to use if they wish.

b. Helvetia

Helvetia regards registered users as duly authorized. Helvetia assumes that any information, queries, orders, actions, instructions, etc. of the user in the MoneyPark Cockpit are actually made by the identified user. Helvetia may use access data or other user data (namely the user's e-mail address) for marketing purposes, aand may also submit offers to the user outside of the MoneyPark Cockpit at any time. Helvetia reserves the right to block user access to the MoneyPark Cockpit without giving reasons.

Helvetia has no obligation to check the accuracy of information entered in the portal by users, and it accepts no liability for damage resulting from information that is incomplete or incorrect.

5. Comparison and valuation services

The comparison and valuation services in the MoneyPark Cockpit are for information purposes only. The results of the comparisons or valuations do not constitute advertising, offers or recommendations to purchase or use the recommended products or services. In particular, Helvetia offers no guarantee that the recommended products and services are actually the most suitable for the user.

6. Disclaimer of warranty and liability

Helvetia assumes no warranties, guarantees and assurances, in particular with regard to the availability, completeness, correctness, freedom from errors of the MoneyPark Cockpit, fitness for purpose or infringement of any third-party rights (copyrights etc., non-infringement) or other services or for the content of external websites. In particular, Helvetia shall not be liable for the accuracy of information on prices achievable on the market, market demand, market supply, construction projects or the like.

To the extent permitted by law, Helvetia excludes all liability for damage caused to the hardware or software of the user or a third party, as well as for any lack of security or functionality of the hardware and software used.

Helvetia excludes all liability (including for its bodies, employees and auxiliary persons) to the extent permitted by law. Helvetia is liable neither for slight and moderate negligence nor for indirect and consequential damage (loss of profit, third-party claims).

All information, content and related presentation methods, designs and software published in the MoneyPark Cockpit are protected by copyright; the rights thereto belong to Helvetia or its licensors.

Any duplication, reproduction, distribution or other commercial use of the information on Helvetia's websites or applications is prohibited without the express permission of Helvetia. This does not apply to information or data expressly authorized by Helvetia for specific purposes (e.g. downloading forms).

7. Data protection and security

All personal data is processed in accordance with current data protection legislation. Information on real estate platform data processing in relation to the MoneyPark Cockpit can be found at www.helvetia.ch/privacy in the latest version published on the website, where users will find further information on the person responsible for processing personal data, data processing within the framework of portal provision, the use of cookies or options for self-administration of their data as well as their rights.

8. Changes to the terms of use

Helvetia may amend, restrict or extend these Terms of Use in part or in full at any time. The user will be notified of changes to the terms of use in a suitable form - as a rule electronically. The user must accept the amended terms of use when accessing real estate platform for the first time in order to be able to continue using real estate platform . If the changes to the Terms of Use are not accepted, the use of the MoneyPark Cockpit ends at the latest on the date on which the changed Terms of Use come into force.

9. Partial nullity

In the event of individual provisions of these Terms and Conditions of Use proving invalid, in whole or in part, this will not affect the validity of the remaining provisions. In the event of an individual provision proving invalid, the invalid provision will be replaced with another clause which most closely reflects the intended purpose of the clause found to be invalid.

10. Further provisions

In addition to these terms of use and the data protection provisions, the legal notices and any other terms and conditions published on Helvetia's websites shall apply.

11. Applicable law and legal venue

These Terms of Use are subject to Swiss law.

For all disputes arising from or in connection with the use of the MoneyPark Cockpit,, the courts at the consumer's place of residence or the courts in Basel or St. Gallen shall have jurisdiction. For actions brought by Helvetia, the court at the domicile of the defendant shall have jurisdiction.
